Essay Contest Rules

 

OFFICIAL ESSAY CONTEST RULES:
NO PURCHASE NECESSARY TO ENTER OR WIN
VOID WHERE PROHIBITED BY LAW
By participating in the contest with BPOA (Berkeley Property Owners Association). Entrants expressly agree to be bound by these rules, terms and conditions.
HOW TO ENTER:
To enter the contest, Entrant must submit during the contest period a complete contest application including their 1500 word or less on one of the following topics:
ü      Rent Control and how it affects Students
ü      Rent Control and the Loss of Rental Housing
ü      The Economics of Rent Control
Must be original work (no plagiarism). All completed entries must be received by the Contest Deadline in order to be considered as a contest entry for the BPOA Rent Control ESSAY CONTEST. All entries must be submitted via electronic submission to bpoa@bpoa.org or via mail to: Attn: Nancy, BPOA Essay Contest BPOA 2041 Bancroft Way , Suite 203, Berkeley , CA 94704
 
All entries are to be submitted by a currently registered Cal Student seeking private rental housing. All contest entries become the property of BPOA and will not be returned. BPOA may use any of the entries for any purpose whatsoever, without further compensation to the entrant. Essays will be read and judged by a panel of qualified judges chosen by BPOA. Essays will be judged on the following criteria: 33 1/3% sincerity, 33 1/3% clarity, and 33 1/3% overall quality of thought. In the event of a tie, entries will be judged on the additional criteria of originality. The Prize money will be written directly to the landlord or property management company
CONTEST PERIOD:
The Contest begins at 12:00:00 A.M. Pacific Time (ET) Zone in the United States on (April 1st, 2009) and ends at 11:59:59 P.M. ET on April 30th, 2009 (“Contest Deadline”).
ELIGIBILITY & GEOGRAPHIC LIMITATIONS:
To be eligible for the prize, all Entrants must be currently registered Cal Student seeking private rental housing. Employees of Sponsor, its subsidiaries, divisions, and related companies, and their respective agencies and agents and immediate family members of such are not eligible.
RESTRICTIONS AND LIMITATION OF LIABILITY:
One entry per person. Alternate entries will result in disqualification. Void where prohibited by law.  BPOA reserves the right to cancel, terminate or modify the contest if it is not capable of completion as planned for any reason, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any kind. The decision of BPOA is final. All federal, state and local laws and regulations apply. BPOA and staff, their subsidiaries and affiliates, their officers, directors, agents, board of directors, insurers, and employees, and their advertising and promotional agencies and sponsors assume no responsibility or liability whatsoever for damages, loss or injury resulting from participating in this contest or acceptance or use of any prize; including but not limited to: (i) lost, late, misdirected, damaged, incomplete or illegible entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (ii) any injury or damage to Entrant’s or any other person’s computer related to or resulting from participating in the contest.
FORUM AND RECOURSE TO JUDICIAL PROCEDURES:
In consideration for participation in this contest and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the submitting parent and/or guardian, on their own and on Entrant’s behalf, and on behalf of their heirs, successors or assigns, administrators and personal representatives, does hereby COVENANT NOT TO SUE, FULLY RELEASE AND FOREVER DISCHARGE BPOA, our partners and related entities, (ii) each of their respective directors, board of directors, officers, employees, agents, insurers, attorneys, shareholders and representatives, and (iii) each predecessor, successor, and assign thereof, from and against any and all actions, charges, claims, losses, costs, damages, expenses (including attorneys’ fees and expenses) and liabilities of any kind or character, whether known or unknown, in connection with, arising out of or in any way related to submitting parent and/or guardian’s and Entrant’s participation in this contest.
These Official Rules shall be governed by, subject to, and construed in accordance with the laws of the State of California, United States of America, excluding all conflict of law rules. If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect. To the extent permitted by law, the rights to litigate, seek injunctive relief or make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Contest are hereby excluded, and all Entrants expressly waive any and all such rights.
ARBITRATION:
By entering the Contest, you agree that exclusive jurisdiction for any dispute, claim, or demand related in any way to the Contest will be decided by binding arbitration. All disputes between you and Sponsor of whatsoever kind or nature arising out of these Terms, shall be submitted to Judicial Arbitration and Mediation Services, Inc. (“JAMS”) for binding arbitration under its rules then in effect in the Berkeley, California, USA area, before one arbitrator to be mutually agreed upon by both parties. The parties agree to share equally in the arbitration costs incurred.
PRIZES/ODDS OF WINNING:
One winner will receive a $500 check payable to a Berkeley California Landlord or management company for the rental of a Berkeley California apartment. There is no retail value. 
ODDS OF WINNING DEPEND UPON THE NUMBER OF ENTRIES RECEIVED
Prizes are non-transferable and non-exchangeable. No substitution or cash equivalent will be made. BPOA reserves the right to substitute a prize of equal or greater value if the awarded prize is unavailable for any reason.
 
HOW TO CLAIM PRIZE:
ESSAY contest winners will be contacted by email and telephone by May 7th, 2009 and must respond by May 9th, 2009 or they forfeit the prize award. All prizes will be awarded. In the event that an award is forfeited, the prize will be awarded to the next qualified entrant on the basis of their ranking in the initial judging. All federal, state and local laws and regulations apply to contest prize awards. All federal, state and local taxes (including any sales taxes) where applicable are the sole responsibility of the winner. Awarded prizes will be delivered to the winner in person at the BPOA Spring Dinner Meeting, 14 May, 6:30PM Hs. Lordships Restaurant, 199 Seawall Drive, Berkeley CA. DISQUALIFICATION AND PENALTIES:
All Entrants agree to be bound by these rules. BPOA in its sole discretion, further reserves the right to disqualify any person for (i) violating any of these rules, (ii) tampering with the entry process or the operation of BPOA website, (iii) gaining an unfair advantage in participating in the contest, (iv) obtaining winner status using fraudulent means, or (v) engaging in otherwise unsportsmanlike, disruptive, annoying, harassing, or threatening behavior. Any attempt by a contestant or any other individual to deliberately circumvent, disrupt or damage ordinary and normal operation of this contest, telephone systems or website, or to undermine the legitimate operation of the contest is a violation of criminal and civil laws. Should such an attempt be made, BPOA reserves the right to seek damages from any such participant to the fullest extent permitted by law.
PUBLICITY RELEASE:
Unless prohibited by law: (i) participation constitutes permission for BPOA and affiliates without any further obligation to the contest participant, to use participant’s name, voice, biographical data and likeness for promotional and marketing purposes; (ii) winners may be required to execute an affidavit of eligibility and liability and publicity release prior to awarding of prize.
ADDITIONAL TERMS AND CONDITIONS:
BPOA reserves the right in its sole discretion to supplement or make changes to the rules of any contest at any time without notice. BPOA reserves the right in its sole discretion to interpret the rules of any contest, and such interpretation shall be binding upon all participants. BPOA shall not be responsible for any administrative errors involved in the execution of any contest or sweepstakes.
